1. Acceptance of Terms
By accessing or using the Attested Intelligence platform, services, documentation, or any associated tools (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.
2. Description of Services
Attested Intelligence provides a governance evidence platform that generates:
- Policy Artifacts: Sealed cryptographic objects encoding authorized states and enforcement parameters
- Enforcement Receipts: Signed proofs of measurements and enforcement actions
- Evidence Bundles: Portable verification packages for offline audit
The Services are tools for generating tamper-evident audit trails. They do not constitute legal certification or formal attestation of any kind.
3. Eligibility
You must be at least 18 years old and have the legal capacity to enter into binding contracts to use the Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.
4. Account Registration
4.1 Account Creation
You may be required to create an account to access certain features. You agree to provide accurate, current, and complete information during registration.
4.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
4.3 API Keys and Cryptographic Keys
You are solely responsible for the security and custody of any API keys, cryptographic keys, or credentials issued to you. Lost or compromised keys may result in loss of access or security incidents.
5. Acceptable Use
5.1 Permitted Use
You may use the Services for lawful purposes consistent with these Terms and any applicable laws and regulations.
5.2 Prohibited Use
You may not:
- Use the Services for any illegal purpose
- Attempt to circumvent security measures or access unauthorized systems
- Interfere with the operation of the Services
- Reverse engineer, decompile, or disassemble the Services (except where permitted by law)
- Use the Services to generate false or misleading audit evidence
- Resell or redistribute the Services without authorization
6. Intellectual Property
6.1 Our Intellectual Property
The Services, including all software, documentation, algorithms, designs, and content, are owned by Attested Intelligence, Inc. and protected by intellectual property laws. We retain all rights not expressly granted.
6.2 Patent Rights
Certain aspects of the Services are covered by pending patent applications. Nothing in these Terms grants you any license to our patents except as necessary to use the Services as intended.
6.3 Your Content
You retain ownership of any data, configurations, or content you submit to the Services. By using the Services, you grant us a limited license to process your content as necessary to provide the Services.
7. Data and Privacy
7.1 Data Processing
Our processing of personal data is governed by our Privacy Policy, which is incorporated by reference into these Terms.
7.2 Evidence Data
Policy Artifacts, Receipts, and Evidence Bundles you create are your data. We do not access the content of your evidence data except as necessary to provide the Services or as required by law.
7.3 Cryptographic Keys
For customer-held key configurations, we do not have access to your private keys. You are solely responsible for key backup and recovery.
10. Disclaimers
10.1 No Guarantee of Outcomes
THE SERVICES ARE TOOLS FOR GENERATING TAMPER-EVIDENT AUDIT TRAILS. WE DO NOT GUARANTEE ANY PARTICULAR LEGAL OR REGULATORY OUTCOME FROM USE OF THE SERVICES. YOU ARE SOLELY RESPONSIBLE FOR DETERMINING THE SUITABILITY OF THE SERVICES FOR YOUR NEEDS.
10.2 As-Is Basis
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10.3 No Legal Advice
Nothing in the Services or documentation constitutes legal advice. Consult qualified legal counsel for any legal or regulatory matters.
11. Limitation of Liability
11.1 Exclusion of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
11.2 Cap on Liability
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
14. General Provisions
14.1 Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
14.2 Dispute Resolution
Any disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court.
14.8 Modifications
We may modify these Terms by posting updated Terms on our website. Continued use after changes constitutes acceptance.
